ORDINANCE NO. 664
CITY OF WACONIA

AN ORDINANCE ANNEXING CERTAIN LAND INTO THE
CORPORATE LIMITS OF THE CITY OF WACONIA,
CARVER COUNTY, MINNESOTA

NOVEMBER 19, 2012

The City Council of the City of Waconia, Carver County, Minnesota, ordains:
SECTION 1. Petitions. The City of Waconia received a petition from the property owner for the annexation of certain property and the property is completely surrounded by land within the municipal limits.
SECTION 2: Hearing. Pursuant to Minnesota Statutes Section 414.033, Subd. 2b a hearing was held by the City Council of the City of Waconia, Minnesota, on November 19, 2012, to consider adoption of an ordinance to annex the land described on “Exhibit A”.
SECTION 3: Notice of Hearing.  30 days’ written notice of said hearing was given to the Town of Waconia (the town affected by the proposed ordinance) and to all landowners within and contiguous to the land to be annexed. All persons interested in said annexation were heard by the Council at the hearing.
SECTION 4: Character of Land. The land to be annexed contains 1.0 acre and is completely surrounded by land within the municipal limits.
SECTION 5: Land Annexed. Pursuant to Minnesota Statutes Section 414.033, the corporate limits of the City of Waconia are hereby declared extended to encompass and include all that certain land situated in the County of Carver legally described as follows:

SECTION 6: Filing. The City Administrator is hereby directed to file copies of the Ordinance with the State of Minnesota, Office of Administrative Hearings – Municipal Boundary Adjustment Unit, the Town Clerk of the Town of Waconia, the Carver County Auditor, and the Minnesota Secretary of State and to publish this Ordinance in the Waconia Patriot, all as required by law.
SECTION 7: Effective Date of Annexation. This Ordinance takes effect upon passage and publication and the filing of copies as directed in Section 6 and approval by the State of Minnesota, Office of Administrative Hearings – Municipal Boundary Adjustments Unit.
SECTION 8: Tax Reimbursement. Pursuant to Minnesota Statutes Section 414.036 the City of Waconia shall reimburse the Town (“Township”) of Waconia $180.51 for the taxable property annexed by this Ordinance. The reimbursement shall be completed in equal payments over two years from the time of annexation. $90.26 shall be payable in 2012 and $90.25 shall be payable in 2013.
There are no special assessments assigned by the Township to the annexed property and no portion of debt incurred by the Town prior to the annexation and attributable to the property annexed that need to be reimbursed.

LEGAL DESCRIPTION

That part of the Southwest Quarter of the Northwest Quarter (SW 1/4 of NW 1/4) of Section 23, Township 116 North, Range 25 West, Carver County, Minnesota, described as follows:
Commencing at the Southwest corner of the Southwest Quarter of the Northwest Quarter of said Section 23; thence Easterly along the South line of said Southwest Quarter of the Northwest Quarter a distance of 872.44 feet to the point of beginning; thence Northerly deflecting to the left 91degrees 52 minutes 08 seconds a distance of 208.82 feet; thence Easterly deflecting to the right 91 degrees 52 minutes 08 seconds a distance of 208.71 feet; thence Southerly deflecting to the right 88 degrees 07 minutes 52 seconds a distance of 208.82 feet to the South line of said Southwest Quarter of the Northwest Quarter; thence Westerly along said South line, a distance of 208.71 feet to the point of beginning. Subject to roadway easement over and across the South 33.0 feet thereof.
