Waconia – Ordinance No. 665

ORDINANCE NO. 2012-665
AN ORDINANCE AMENDING CHAPTER 620 OF THE WACONIA CITY CODE
REGARDING DESIGNATED USE OF STREETS
The City Council of the City of Waconia does hereby ordain:
FINDINGS AND PURPOSE
Minnesota Statutes §169.87, Subd. 1 (c), allows a municipality to prohibit the operation of trucks or other commercial vehicles on streets within its jurisdiction by ordinance. This same provision also allows a municipality to enforce weight restrictions on such vehicles by ordinance. Pursuant to Minnesota Statutes §169.87, Subd. 1 (a), a municipality may also prohibit vehicles or restrict weights whenever any street, by reason of deterioration, rain, snow, or other climatic conditions, will be seriously damaged or destroyed by certain traffic.
The City Council finds that truck and commercial vehicle traffic creates a danger to children and other citizens on certain streets. The City Council further finds that heavy truck traffic over certain City streets will result in serious damage to such streets. The purpose of this ordinance is to regulate traffic on City streets that is dangerous to the public or poses an unreasonable risk of serious damage to the streets. This ordinance also deletes an obsolete provision.
SECTION 1. Section 620.02 of the Waconia City Code (regarding truck restrictions) is amended, in its entirety.
SECTION 2. Section 620.04 of the Waconia City Code (regarding prohibition of certain vehicles) is deleted in its entirety.
SECTION 3. The remainder of Chapter 620 shall remain unchanged and in full force and effect.
SECTION 4. The full text of Ordinance No. 665 is on file for public inspection in the office of the city clerk during regular business hours or www.waconia.org.
SECTION 5. This ordinance shall be in full force and effect upon publication.
